RAINBOW SPRINKLE STUDIO – TERMS OF USE

1. Ownership of Artwork
All artwork, clipart, illustrations, and digital files (“Artwork”) are copyrighted and remain the exclusive property of Rainbow Sprinkle Studio – Sasha Mitten.
Purchasing or downloading Artwork gives you a license to use the files—not ownership.
You may not claim the art as your own or create derivative clipart.
2. License Types
All purchases include a Standard Educational Use License unless otherwise stated.
Certain uses require an Extended License (see Section 5).
3. Permitted Uses (Standard License)
You may use Artwork in the following ways:
Educational Resources (Paid or Free)
Worksheets, task cards, slides, games, posters, labels, color-by-code (with added text), and other resources containing educational content.
Editable Resources
Allowed if some text remains non-editable and the clipart cannot be extracted.
Digital Platforms
Use is permitted on sites such as TPT, Boom Cards™, Google Slides™, Canva™, Seesaw™, and similar platforms.
Personal Classroom Use
Classroom decor, stickers, coloring pages, and crafts for personal use (not for sale and not redistributed).
Your Own Branding
Use in your own TPT store banner, your personal teacher blog, or social graphics (not for client work).
Professional Development
Use in your own PD presentations, workshops, or instructional videos (non-commercial services).
Secured Formats
All Artwork must be flattened or secured in PDFs, JPGs, PNGs, or other non-extractable formats.
4. Not Permitted (Standard License)
You may NOT:
Sell or Share Clipart as Standalone Files
No redistribution, no freebies, no sharing of the raw files.
Use Artwork Without Educational Content
No image-only stickers, coloring pages, paper crafts, or decor for sale.
Create Logos or Designs for Others
No client branding, logo design, website design, or commercial design services.
Alter, Recolor, or Modify Artwork
No editing, recoloring, erasing features, or creating derivative clipart.
Use on Physical Products for Sale
No T-shirts, mugs, stationery, stickers, print-on-demand, or hard goods without a separate license.
Train AI Models
You may not upload Artwork to AI tools or use it to train machine-learning systems.
5. Uses Requiring an Extended License
An Extended License is required for:
Drag-and-Drop / Movable Digital Activities
Boom Cards™, Google Slides™, Seesaw™, etc.
Amazon / KDP or Print-on-Demand Books for Sale
You must:
Purchase the Extended KDP License
Register it via the required Google Form
Follow all file-flattening / hardening requirements
6. Credit Requirements
Credit is required on all free or paid resources unless otherwise stated.

7. Membership License Terms (If Applicable)
Active Membership Required
Your license applies only while your membership is active.
No Shared Accounts
Membership credentials may not be shared.
Download Limits
Excessive or automated downloading may result in suspension.
8. Prohibited Conduct
Users may NOT:
Extract artwork from secured PDFs
Upload clipart to file-sharing sites
Reverse-engineer or isolate PNGs from products
Train AI on Artwork
Use Artwork in defamatory, illegal, or hateful content
9. Termination of License
Your license may be terminated if you:
Violate any Terms
Redistribute, alter, or misuse artwork
Provide false information
Upon termination, you must stop using the Artwork in new products immediately.
10. No Warranty
All Artwork is provided “as is” without warranties of any kind.
11. Limitation of Liability
Our liability is limited to the amount you paid for the product.
We are not liable for indirect, incidental, or consequential damages.
12. Indemnification
You agree to indemnify, defend, and hold harmless Rainbow Sprinkle Studio and its owners, Sasha and Jack Mitten, from any claims, damages, or expenses arising from:
Your misuse of Artwork
Your breach of these Terms
Your violation of third-party rights
Your use of Artwork in products sold to others

14. Governing Law
These Terms are governed by the laws of the state where Rainbow Sprinkle Studio is based.
15. Updates to These Terms
We may update or modify these Terms at any time.
Your continued use of Artwork constitutes acceptance of updated Terms.
16. Commercial Use Restrictions for Commercial Entities
The Artwork licensed under these Terms is intended for individual educators, classroom creators, and small-scale businesses. Commercial entities and organizations engaging in commercial use are prohibited from using the Artwork without obtaining a separate written commercial license signed by both owners, Sasha Mitten and Jack Mitten.
For the purposes of this Agreement, a “commercial entity” includes, but is not limited to:
Corporations
Educational publishers
Curriculum development companies
EdTech platforms
Agencies or marketing firms
Any organization with 10 or more employees
Any organization with annual revenue of $250,000 or more
Funded or venture-backed startups
Any business using the Artwork at scale or for mass distribution
Commercial use includes, but is not limited to:
Curriculum, instructional programs, or mass-distributed educational materials
Merchandise, physical goods, product packaging
Company branding, marketing, advertising, or social media campaigns
Use within software, apps, or digital platforms
Any product or service generating revenue for an organization
Unauthorized commercial use is strictly prohibited and constitutes copyright infringement. Rainbow Sprinkle Studio reserves all legal rights to enforce its intellectual property through DMCA takedowns, license revocation, and/or legal action.
