RAINBOW SPRINKLE STUDIO – TERMS OF USE

1. Ownership of Artwork

All artwork, clipart, illustrations, and digital files (“Artwork”) are copyrighted and remain the exclusive property of Rainbow Sprinkle Studio – Sasha Mitten.

Purchasing or downloading Artwork grants you a license to use the files — not ownership.

You may not claim the art as your own or create derivative clipart.

These Terms exist to protect the integrity of our artwork and the small creative business behind it.

2. License Types

All purchases include a Standard Educational Use License unless otherwise stated. Certain uses require an Extended License (see Section 5).

All licenses are non-exclusive, non-transferable, and revocable upon violation of these Terms.

3. Permitted Uses (Standard License)

You may use Artwork in the following ways:

Educational Resources (Paid or Free)

Worksheets, task cards, slides, games, posters, labels, color-by-code (with added educational content), and other resources containing instructional material.

Editable Resources

Allowed if some text remains non-editable and the clipart cannot be extracted.

Digital Platforms

Use is permitted on platforms such as:

• Teachers Pay Teachers (TPT)
• Boom Cards™
• Google Slides™
• Canva™
• Seesaw™

and similar educational platforms, provided files are secured and not extractable.

Personal Classroom Use

Classroom decor, stickers, coloring pages, and crafts for personal classroom use (not for sale and not redistributed).

Your Own Branding

Use in your own TPT store banner, personal teacher blog, or social graphics.

(Not permitted for client work or commercial branding for others.)

Professional Development

Use in your own professional development presentations, workshops, or instructional videos.

Secured Formats

All Artwork must be flattened or secured in PDFs, JPGs, PNGs, or other non-extractable formats when distributed.

Minor Adjustments

Minor resizing, cropping, and layering within educational resources is permitted.

However, altering the core design, recoloring elements, erasing features, or creating derivative clipart is prohibited.

4. Not Permitted (Standard License)

You may NOT:

• Sell, share, or redistribute clipart as standalone files
• Offer raw files as freebies or bonuses
• Use Artwork without educational content in products for sale
• Create logos, branding, or designs for clients or third parties
• Incorporate Artwork into competing clipart packs, graphics bundles, design kits, or assets intended for resale
• Alter, recolor, erase, or modify Artwork to create derivative clipart
• Use Artwork on physical products for sale (T-shirts, mugs, stationery, stickers, packaging, etc.) without a separate license
• Upload Artwork to file-sharing or stock websites
• Extract PNGs from secured files
• Reverse-engineer or isolate artwork elements
• Use Artwork in defamatory, illegal, hateful, or harmful content
• Upload Artwork to AI systems for training, dataset inclusion, style replication, generative prompting, or machine-learning development

5. Uses Requiring an Extended License

An Extended License is required for:

• Drag-and-drop or movable digital activities
(Boom Cards™, Google Slides™, Seesaw™, etc.)

• Amazon KDP books or print-on-demand books for sale

KDP Users Must

• Purchase the Extended KDP License
• Register the license via the required Google Form
• Follow all file-flattening and security requirements

Each license applies to one published book.

6. Credit Requirements

Credit is required on all free or paid resources unless otherwise stated.

7. Membership License Terms

Active Membership Access

Access to the clipart library, downloads, updates, and new releases is available only while membership is active.

Permanent License for Downloaded Files

Artwork downloaded during an active membership period is permanently licensed and may continue to be used in products created during or after the membership period.

However:

• Access to new downloads ends immediately upon cancellation.
• Rejoining does not retroactively validate unlicensed use during inactive periods.

No Shared Accounts

Membership credentials may not be shared.

Each membership is licensed to one individual user only.

Download Monitoring

Rainbow Sprinkle Studio reserves the right to monitor download activity.

Excessive, automated, or suspicious downloading activity may result in:

• temporary suspension
• download limits
• or termination of membership access.

Abuse of Membership Downloads

Membership access is intended for reasonable personal use in creating educational resources.

Downloading extremely large portions of the library within a short timeframe for the purpose of archiving, stockpiling, or retaining files after cancellation may be considered abuse of the membership system.

Rainbow Sprinkle Studio reserves the right to:

• restrict download access
• investigate suspicious activity
• suspend or terminate memberships engaged in abusive downloading behavior.

8. Service Availability

Rainbow Sprinkle Studio makes every reasonable effort to maintain uninterrupted access to the website, membership library, and downloads.

However, temporary interruptions may occur due to:

• website maintenance
• hosting outages
• software updates
• technical failures
• high traffic events
• circumstances beyond our control.

While we will work to restore service as quickly as possible, uninterrupted availability is not guaranteed.

Temporary service interruptions do not entitle members to refunds, prorated refunds, or credits.

9. Automated Access and Scraping

The use of bots, scraping tools, automated downloaders, crawlers, scripts, or data extraction technologies to access or download Artwork from the website is strictly prohibited.

Attempting to systematically download large portions of the library, archive the collection, or replicate the library outside the membership platform is not permitted.

Accounts engaging in automated or scraping activity may be immediately terminated.

10. No Transfer of License

Licenses are granted to the individual purchaser only and may not be transferred, assigned, sublicensed, or included in the sale or transfer of a business, digital store, or product catalog without written permission.

11. Store Transfers and Business Sales

If a Teachers Pay Teachers store, website, business, or digital product catalog containing resources created with Rainbow Sprinkle Studio Artwork is sold or transferred to another party, the Artwork license does not transfer to the new owner.

The new owner must purchase their own valid licenses or membership in order to continue selling or distributing products that contain Rainbow Sprinkle Studio Artwork.

Unauthorized continued use by a new owner without obtaining proper licensing constitutes unauthorized use of copyrighted artwork.

12. Commercial Use Restrictions

The Artwork licensed under these Terms is intended for individual educators, classroom creators, and small-scale businesses.

Organizations using Artwork for mass distribution, commercial curriculum programs, software platforms, or revenue-generating commercial operations must obtain a separate written commercial license.

Unauthorized commercial use constitutes copyright infringement.

Rainbow Sprinkle Studio reserves all legal rights to enforce its intellectual property through:

• DMCA takedowns
• license revocation
• legal action.

13. Prohibited Conduct

Users may NOT:

• Extract artwork from secured PDFs
• Upload clipart to file-sharing sites
• Reverse-engineer PNG files
• Attempt to bypass download protections
• Train AI systems using Artwork
• Use Artwork in illegal or harmful content

Rainbow Sprinkle Studio reserves the right to investigate suspected violations and request documentation demonstrating compliance with these Terms.

14. Chargebacks and Payment Disputes

Initiating a chargeback or payment dispute after downloading Artwork or accessing membership content constitutes a violation of these Terms.

If a chargeback is filed:

• the license granted to the user may be revoked
• membership access may be terminated
• future purchases may be blocked

Rainbow Sprinkle Studio reserves the right to provide documentation to payment processors demonstrating delivery of digital goods and membership access.

15. Termination of License

Your license may be terminated if you:

• violate any Terms
• redistribute or misuse Artwork
• engage in scraping or automated downloading
• initiate fraudulent chargebacks
• provide false information.

Upon termination, you must immediately stop using the Artwork in new products.

16. No Warranty

All Artwork, downloads, and website services are provided “as is” and “as available” without warranties of any kind, express or implied.

17. Limitation of Liability

Liability is limited to the amount paid for the product or membership.

Rainbow Sprinkle Studio shall not be liable for indirect, incidental, or consequential damages.

18. Indemnification

You agree to indemnify, defend, and hold harmless Rainbow Sprinkle Studio and its owners, Sasha and Jack Mitten, from any claims arising from:

• misuse of Artwork
• breach of these Terms
• violation of third-party rights
• products you create using the Artwork.

19. DMCA Notice

To report copyright violations:

20. Governing Law

These Terms are governed by the laws of the State of Connecticut.

21. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions remain in full force and effect.

22. No Waiver

Failure to enforce any provision does not waive the right to enforce it later.

23. Updates to These Terms

Rainbow Sprinkle Studio reserves the right to update or modify these Terms at any time.

Updated Terms will be posted with a revised Last Updated date.

Continued use of Artwork after changes constitutes acceptance of the revised Terms.

24. Entire Agreement

These Terms govern all purchases and downloads of Artwork from Rainbow Sprinkle Studio, whether purchased individually or accessed through membership.

A summarized license sheet may be included within digital downloads for convenience. In the event of any conflict between a product-level license summary and these website Terms, these website Terms shall control.
